West Coast Growers Terms and Conditions

Read all terms and conditions before ordering.
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ORDERING.
By placing an order, you agree to the following terms and conditions.
TERMS WHOLESALE: Wholesale accounts are eligible for NET 30 terms upon approval of credit. Otherwise all sales will be prepaid or COD, and are payable in money order or certified check unless prior approval has been obtained for a company check. All sales to foreign countries (including Canada) will be on a prepaid basis, unless other specific arrangements have been made. All payments must be in U.S. dollars. 2% service charge per month on overdue balances.
DELIVERY DATES: Quoted delivery dates are estimates only. West Coast Growers assumes no responsibility for failure to deliver by estimated date. Unless otherwise specified, items are typically shipped via FedEx ground or FedEx Freight. Inventory is limited to stock on hand and may be subject to backorder. Allow One to Three weeks for delivery. Shipping fees apply to all orders.
RETURNS: Please let us know if you are having problems with one of our products, or if the product is damaged or defective. If possible, we will assist you in attempting to correct the problem before resorting to a return. A Return Materials Authorization form (RMA) must be obtained in advance for any items returned and will be reimbursed as a separate financial transaction against the RMA within 90 days. When calling for a Return Materials Authorization (RMA), please be prepared with the following:
1. Name, part number, and description of item to be returned.
2. A complete description of the problem, as well as a description of any attempts to correct the problem.
3. Proof of sale will be required for warranty coverage.
When sending an item back:
1. Be sure returns are properly packaged. We are not responsible for damage due to improper packaging.
2. The return material authorization (RMA) number must be clearly written on the outside of the package in marker pen.
3. We will cover return shipping charges on warranty items.
4. There is a 20% restock fee for returns due to overstock or ordering errors.
LIGHT MOVER RETURNS: When returning Light Movers, ship the body only; do not include arms, hangers or accessories, J-box covers etc. Be sure to pack unit securely in the original packaging to prevent damage from occurring during shipping.
NOTE: Removing or repairing motor without prior authorization will void the warranty on the unit in full.
FREIGHT DAMAGE: To make dealing with damaged goods as painless as possible, please follow this:
1. Inspect shipment carefully before signing for goods received.
2. If concealed damage is discovered, contact the freight carrier immediately. It is essential that both the damaged item and packaging be retained for inspection in the condition in which they were received.
3. Whenever damage is discovered, please contact West Coast Growers immediately. West Coast Growers is not responsible for damage incurred during shipping. Always report damage within 48 hours to ensure your return.

JURISDICTION: This catalog was created and distributed by West Coast growers from it’s offices within the jurisdiction of California. West Coast Growers makes no representation that materials in this catalog are appropriate or available for use in other locations. Those who choose to access this catalog from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extend applicable. This agreement shall be governed by and construed in accordance with the laws of the State Of California. If any provisions of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not effect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing, signed by West Coast Growers.

TERMINATION: This agreement is effective until terminated by either party. You may terminate this agreement at any time by destroying all materials obtained from West Coast Growers and all related documentation, software, soft-copy and hard all copies, whether made under the terms of this agreement or otherwise. This agreement will terminate immediately without notice from West Coast Growers, if, in West Coast Growers sole discretion, you fail to comply with any term or provision of this agreement or for any other reason West Coast growers deems reasonable.
DISCLAIMER: TO THE FULLEST EXTEND PERMISSIBLE PURSUANT TO APPLICABLE LAW, WEST COAST GROWERS DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE. WEST COAST GROWERS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OT THE RESULTS OF THE USE OF THE MATERIALS IN THIS CATALOG IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY OR MAY NOT APPLY TO YOU.
